Overstay Penalties in Hong Kong for Nepali Tourists — Fines & Imprisonment Law

Many Nepali citizens visit Hong Kong each year for tourism, business, or family purposes. However, it is crucial to understand that overstaying your visa or entry permit in Hong Kong is a serious criminal offence under Section 41 of the Immigration Ordinance (Cap. 115). Once your visa or permitted stay expires, remaining in Hong Kong without legal extension is officially considered a “breach of condition of stay.” The Hong Kong government imposes strict penalties to maintain immigration discipline and control unlawful residence.

Under this law, anyone who overstays can face a maximum fine of HK$50,000 and imprisonment for up to two years. Even short overstays — sometimes just one or two days — can result in detention, questioning, and prosecution by the Immigration Department. When caught overstaying, individuals are typically detained for verification for up to 48 hours and may have to surrender their travel documents until their case is resolved. If convicted, the person receives a criminal record, which can affect future visa applications for Hong Kong and other countries.

Hong Kong’s Immigration Department takes overstay violations very seriously because they are often associated with illegal employment or residence. If a visitor is found to have worked or earned income while overstaying, the case becomes more severe and usually results in a longer prison sentence or immediate deportation. The Hong Kong courts consider several factors before deciding punishment — such as the duration of overstay, reason for overstaying (like medical emergency or flight cancellation), and whether the person worked illegally.

Apart from fines and imprisonment, the Immigration Department can also issue Removal or Deportation Orders. These orders may ban the individual from re-entering Hong Kong for several years. Once deported, a record remains in the immigration system, making it difficult for the person to obtain future visas or work permits, not only in Hong Kong but also in neighboring regions such as Macau or Mainland China. Furthermore, travelers with an overstay record are often refused boarding by airlines if they try to return using a new visa before the ban expires.

Applications submitted within 14 days of visa expiry are processed within 1–2 working days. Overstaying even for a short time before applying can lead to rejection.
