भट्ट र अग्रवालसँग विभिन्न मुद्दामा धरौटी मागCourt Seeks Bail from Bhatt and Agrawal in Insurance and Securities Cases

काठमाडौं — जिल्ला अदालत काठमाडौंले बीमा तथा धितोपत्र कारोबारसम्बन्धी कसुरको अभियोग लागेका व्यवसायी दीपक भट्ट र सुलभ अग्रवाललाई धरौटीमा मुद्दाको पुर्पक्ष गर्न आदेश दिएको छ।

न्यायाधीश शिवप्रसाद आचार्यको इजलासले करिब एक सातासम्म चलेको थुनछेक बहसपछि बिहीबार बीमासम्बन्धी मुद्दामा भट्टसँग एक करोड ५० लाख र अग्रवालसँग दुई करोड रुपैयाँ धरौटी माग गरेको हो।

धितोपत्रसम्बन्धी अर्को मुद्दामा अग्रवालसँग एक करोड ५० लाख र भट्टसँग एक करोड रुपैयाँ धरौटी मागिएको छ। उनीहरूमाथि सेयर खरिद–बिक्री, रकम भुक्तानी तथा कम्पनीको लगानी प्रयोगमा कानुनी व्यवस्था उल्लंघन गरेको आरोप छ।

हिमालयन रिइन्स्योरेन्सको संस्थापक सेयर कारोबारसँग सम्बन्धित छुट्टै मुद्दामा अदालतले अग्रवालसँग थप दुई करोड ३० लाख रुपैयाँ धरौटी माग गरेको छ। उक्त मुद्दामा नक्कली भनिएको ‘असाइनमेन्ट’ कागजात प्रयोग गरी संस्थापक सेयरको स्वामित्व हस्तान्तरण गरेको अभियोग लगाइएको छ।

जिल्ला अदालतबाट धरौटीमा पुर्पक्ष गर्ने आदेश भए पनि भट्ट र अग्रवाल तत्काल रिहा हुने छैनन्। उनीहरूविरुद्ध विशेष अदालतमा चलिरहेको सम्पत्ति शुद्धीकरण मुद्दामा यसअघि नै थुनामै राखेर मुद्दा अघि बढाउने आदेश भएको छ।

सम्पत्ति शुद्धीकरण अनुसन्धान विभागको प्रतिवेदनका आधारमा दायर मुद्दामा गैरकानुनी रूपमा सम्पत्ति आर्जन गरी स्रोत लुकाएको आरोप लगाइएको छ। विशेष अदालतको आदेश कायमै रहेसम्म जिल्ला अदालतमा धरौटी बुझाए पनि दुवै जना थुनामै रहनेछन्।

एउटै व्यक्तिविरुद्ध फरक कानुनअन्तर्गत विभिन्न अदालतमा मुद्दा चलिरहेको अवस्थामा एउटा मुद्दामा रिहा हुने आदेश आउँदैमा अन्य मुद्दाबाट स्वतः रिहाइ हुँदैन।

अदालतले मागेको धरौटीलाई आरोप प्रमाणित भएको अर्थमा भने बुझ्न मिल्दैन। मुद्दाको नियमित सुनुवाइ, प्रमाण परीक्षण र दुवै पक्षको बहसपछि मात्रै अन्तिम फैसला हुनेछ। फैसला नआएसम्म भट्ट र अग्रवाल कानुनी रूपमा आरोपित मात्र रहनेछन्।

Kathmandu — The Kathmandu District Court has ordered businesspeople Deepak Bhatt and Sulav Agrawal to face trial after depositing bail in cases related to alleged insurance and securities offences.

Following nearly a week of detention hearings, a bench of Judge Shiv Prasad Acharya on Thursday sought Rs 15 million in bail from Bhatt and Rs 20 million from Agrawal in the insurance-related case.

In a separate securities case, the court sought Rs 15 million from Agrawal and Rs 10 million from Bhatt. They have been accused of violating legal provisions related to share trading, payment settlement and the use of company investments.

In another case involving the sale of promoter shares of Himalayan Reinsurance, the court ordered Agrawal to deposit an additional Rs 23 million. The case concerns allegations that a forged assignment document was used to transfer ownership of promoter shares.

Despite the district court’s bail order, Bhatt and Agrawal will not be released immediately. The Special Court has already ordered that they remain in custody while a separate money-laundering case proceeds.

The money-laundering case was filed on the basis of an investigation by the Department of Money Laundering Investigation. Prosecutors have accused them of acquiring assets through unlawful insurance, securities and banking transactions and concealing the source of the funds.

As long as the Special Court’s detention order remains in force, the two will remain in custody even after depositing bail in the district court cases.

When separate cases are being heard under different laws and in different courts, an order for release in one case does not automatically result in release from all other cases.

The bail order does not mean that the allegations have been proven. A final decision will be made only after the court examines the evidence and hears arguments from both the prosecution and the defence.

Until the courts issue final verdicts, Bhatt and Agrawal will remain legally accused, not convicted.
