नक्कली भुटानी शरणार्थी प्रकरणमा काठमाडौं जिल्ला अदालतले पूर्वउपप्रधानमन्त्री टोपबहादुर रायमाझीलाई ४ वर्ष कैद र ४० हजार रुपैयाँ जरिवाना सजाय सुनाएको छ। पूर्वगृहमन्त्री बालकृष्ण खाणलाई भने २ वर्ष कैद र २० हजार रुपैयाँ जरिवाना तोकिएको छ।

न्यायाधीश तेजबहादुर खड्काको इजलासले मंगलबार दोषी ठहर भइसकेका १६ जनाको सजाय निर्धारण गरेको हो। यसअघि २३ असारमा अदालतले ३१ मध्ये १६ जनालाई दोषी ठहर गर्दै ७ जनालाई सफाइ दिएको र फरार ८ जनाको मुद्दा मुल्तबीमा राखेको थियो।

रायमाझी ठगी, संगठित अपराध र राज्यविरुद्धको कसुरमा दोषी ठहर भएका थिए भने खाणलाई मतियारका रूपमा दोषी पाइएको छ।

रायमाझीसँगै पूर्वगृहसचिव टेकनारायण पाण्डे, पूर्वसांसद आङटावा शेर्पा, सुरक्षा सल्लाहकार इन्द्रजित राई, तथा गिरोहका सदस्य केशव दुलाल, सानु भण्डारी, सागर राई, सन्देश शर्मा र गोविन्द चौधरीलाई पनि ४–४ वर्ष कैद तोकिएको छ।

अदालतले नेपाली नागरिकलाई नक्कली भुटानी शरणार्थी बनाएर अमेरिका पठाउने योजनालाई राज्यविरुद्धको कसुरका रूपमा व्याख्या गर्दै यसले नेपालको अन्तर्राष्ट्रिय छवि धमिलिएको उल्लेख गरेको छ।

ज्येष्ठ नागरिक भएकाले इन्द्रजित राईको सजायमा भने कानुनबमोजिम छुट दिइएको छ। यो मुद्दा २०८० जेठमा दायर भएको थियो र फरार प्रतिवादी पक्राउ परेपछि उनीहरूको मुद्दा अघि बढ्नेछ।

The Kathmandu District Court has sentenced former Deputy Prime Minister Top Bahadur Rayamajhi to four years in prison and a fine of Rs 40,000 in the fake Bhutanese refugee case. Former Home Minister Balkrishna Khand was given two years in prison and a Rs 20,000 fine.

The bench of Judge Tej Bahadur Khadka determined the sentences for the 16 people already found guilty on Tuesday. Earlier, on 23 Ashar, the court had convicted 16 of the 31 defendants, acquitted seven, and held the cases of eight absconding defendants in abeyance.

Rayamajhi was convicted of fraud, organized crime and offenses against the state, while Khand was found guilty as an accomplice.

Along with Rayamajhi, former Home Secretary Teknarayan Pandey, former lawmaker Angtawa Sherpa, security adviser Indrajit Rai, and gang members Keshav Dulal, Sanu Bhandari, Sagar Rai, Sandesh Sharma and Govinda Chaudhary were also handed four-year prison terms each.

The court characterized the scheme to disguise Nepali citizens as fake Bhutanese refugees and send them to the United States as an offense against the state, noting that it had tarnished Nepal's international image.

As a senior citizen, Indrajit Rai received a reduction in his sentence under the law. The case was filed in Jeth 2080, and the proceedings against the absconding defendants will resume once they are arrested.
