गभर्नर नियुक्तिमा ढिलाइ : राजनीतिक भागबन्डा र कानुनी प्रक्रिया अल्झियोGovernor Appointment Stalled: Political Tug-of-War and Legal Hurdles Delay Process
नेपाल राष्ट्र बैंकको १८औं गभर्नर नियुक्तिमा सरकारले अझै सफलता हासिल गर्न सकेको छैन। गत चैत २२ गते १७औं गभर्नर महाप्रसाद अधिकारीको कार्यकाल समाप्त भए पनि नयाँ गभर्नर नियुक्ति प्रक्रिया राजनीतिक भागबन्डा र कानुनी अड्चनले थलेको छ।
सत्ता गठबन्धनका प्रमुख घटक नेकपा एमाले र नेपाली कांग्रेसबीच डा. गुणाकर भट्टलाई गभर्नर बनाउने सहमति भए पनि योग्यता सम्बन्धी विवाद सर्वोच्च अदालतसम्म पुगेपछि नियुक्ति प्रक्रिया अल्झिएको हो। भट्टविरुद्ध दायर पूरक रिट निवेदनमाथि सुनुवाइ पाँचौ पटक पनि हेर्न नभ्याइनेमा राखिएको छ। आज न्यायाधीश हरिप्रसाद फुयाल र टेकप्रसाद ढुंगानाको इजलासमा मुद्दा १३ औं नम्बरमा परे पनि फेरी पनि स्थगित भयो।
यता भट्टले राष्ट्र बैंकको कार्यकारी निर्देशकबाट दिएको राजीनामा समेत अझै स्वीकृत हुन सकेको छैन। उपप्रधान तथा अर्थमन्त्री विष्णुप्रसाद पौडेलले कामु गभर्नर नीलम तिम्सिना ढुंगानालाई राजीनामा स्वीकृत गर्न निर्देशन दिएका छन्। तर ढुंगाना स्वयं गभर्नरको आकांक्षी भएकाले उनले राजीनामा स्वीकृत नगरेको आशंका गरिएको छ।
शनिबार साँझ प्रधानमन्त्री केपी शर्मा ओली, कांग्रेस सभापति शेरबहादुर देउवा, उपप्रधानमन्त्री पौडेल र गृहमन्त्री रमेश लेखकबीच गभर्नर नियुक्तिका विषयमा सहमति जुटाउन बैठकसमेत भएको थियो।
यसैबीच, प्रतिपक्षी दलहरू माओवादी केन्द्र र राष्ट्रिय स्वतन्त्र पार्टीले गभर्नर नियुक्ति तत्काल गर्न सरकारसँग माग गरेका छन्। संसद्मा माओवादी सांसद माधव सापकोटाले गभर्नर नियुक्तिमा कर्पोरेट हाउस र विचौलियाको प्रभाव रहेको भन्दै प्रधानमन्त्रीसँग जवाफ माग गरे। त्यस्तै, राष्ट्रिय स्वतन्त्र पार्टीका सांसद मनीष झाले सत्ता गठबन्धनको बौद्धिक दरिद्रता देखिएको टिप्पणी गरे।
नेपाल राष्ट्र बैंक ऐन २०५८ अनुसार, गभर्नरको कार्यकाल सकिनु एक महिना अगाडि नै नयाँ नियुक्ति प्रक्रिया सक्नुपर्ने कानुनी व्यवस्था छ। तर महाप्रसाद अधिकारीको कार्यकाल समाप्त भएको एक महिनासम्म पनि नयाँ गभर्नर नियुक्ति हुन नसक्नु सरकारको असक्षमता र राजनीतिक स्वार्थको नांगो प्रदर्शन हो।
The government has yet to appoint the 18th Governor of Nepal Rastra Bank, even though the term of the 17th Governor, Maha Prasad Adhikari, ended on April 4. The appointment process has been stalled due to political bargaining and legal complications.
Although the ruling coalition partners, CPN-UML and Nepali Congress, had agreed to appoint Dr. Gunakar Bhatt as the new Governor, a supplementary writ challenging his qualifications has reached the Supreme Court. The case, scheduled for today under Justices Hari Prasad Phuyal and Tek Prasad Dhungana, was again deferred for the fifth time without a hearing.
Meanwhile, Bhatt's resignation from his post as Executive Director of Nepal Rastra Bank has not yet been approved. Deputy Prime Minister and Finance Minister Bishnu Prasad Paudel has instructed Acting Governor Neelam Dhungana Timilsina to approve the resignation. However, there is speculation that Dhungana, who is also a contender for the Governor's post, is intentionally delaying the approval.
On Saturday evening, Prime Minister KP Sharma Oli, Congress President Sher Bahadur Deuba, Finance Minister Paudel, and Home Minister Ramesh Lekhak met to settle the issue and move the appointment process forward.
In the meantime, opposition parties, including the CPN (Maoist Centre) and Rastriya Swatantra Party, have demanded immediate appointment of the Governor. Maoist MP Madhav Sapkota accused the government of being influenced by corporate houses and middlemen in the appointment process, and called for a response from the Prime Minister in Parliament. Similarly, Rastriya Swatantra Party MP Manish Jha criticized the ruling coalition for "intellectual bankruptcy" over the delay.
According to the Nepal Rastra Bank Act 2058, the process to appoint a new Governor should be completed and made public at least one month before the position becomes vacant. However, despite Maha Prasad Adhikari’s term ending more than a month ago, the government has failed to fulfill this legal requirement, exposing its inefficiency and political entanglement.
