शंकर ग्रुपका अध्यक्ष शंकरलाल अग्रवाल तीन महिनाभित्र दोस्रोपटक पक्राउ परेका छन्। नेपाल प्रहरीको केन्द्रीय अनुसन्धान ब्युरो (सीआईबी)ले बुधबार उनलाई काठमाडौंको डिल्लीबजारबाट नियन्त्रणमा लिएर बैंकिङ कसुरसम्बन्धी मुद्दाको कानुनी प्रक्रियाका लागि उच्च अदालत पाटनमा उपस्थित गराएको हो। यसपटकको पक्राउ बैंकबाट लिएको कर्जा तोकिएको प्रयोजनभन्दा बाहिर प्रयोग गरिएको आरोपसँग सम्बन्धित मुद्दामा भएको प्रहरीले जनाएको छ।
अग्रवाल यसअघि गत चैतमा सम्पत्ति शुद्धीकरणसम्बन्धी अनुसन्धानका क्रममा पक्राउ परेका थिए। त्यसबेला बयान लिएपछि उनी हाजिरी जमानीमा रिहा भएका थिए। अहिलेको गिरफ्तारी भने सोही अनुसन्धानको निरन्तरता नभई अदालतमा विचाराधीन छुट्टै बैंकिङ कसुर मुद्दासँग जोडिएको हो।
अनुसन्धानका क्रममा जगदम्बा स्टिल्सले उद्योग सञ्चालन तथा चालु पुँजीका लागि विभिन्न बैंकबाट लिएको कर्जामध्ये केही रकम तोकिएको प्रयोजनभन्दा बाहिर प्रयोग भएको आरोप लगाइएको छ। अभियोजन पक्षका अनुसार कर्जाबाट प्राप्त रकम विभिन्न कारोबार हुँदै अन्य लगानीमा प्रयोग गरिएको देखिएको भन्दै शंकरलाल अग्रवालसहित साहिल अग्रवाल, सुलभ अग्रवाल र व्यवसायी दीपक भट्टविरुद्ध मुद्दा दायर गरिएको हो।
अभियोगपत्रमा शंकरलाल अग्रवालको नाम कम्पनीको बैंक खाता तथा वित्तीय कारोबारसँग जोडिएको भूमिकाका आधारमा प्रतिवादी बनाइएको छ। अनुसन्धान पक्षले उनीसहितका प्रतिवादीबीच मिलेमतो रहेको दाबी गरेको भए पनि त्यसको अन्तिम निष्कर्ष अदालतको सुनुवाइपछि मात्रै आउनेछ।
बैंकिङ कसुर ऐनअन्तर्गत दायर मुद्दामा अभियोजन पक्षले बिगो असुलीसहित कैद र जरिवानाको माग गरेको छ। अब उच्च अदालत पाटनले उपलब्ध प्रमाण, प्रतिवादीको बयान र दुवै पक्षको बहसका आधारमा थुनछेकसहित मुद्दाको थप प्रक्रिया अघि बढाउनेछ। मुद्दाको अन्तिम फैसला नआउँदासम्म अग्रवाल कानुनतः दोषी ठहरिएका मानिने छैनन्।
Shanker Group Chairman Shankarlal Agrawal has been arrested for the second time in three months. Nepal Police's Central Investigation Bureau (CIB) detained him in Dillibazar, Kathmandu, on Wednesday and produced him before the Patan High Court in connection with a banking offence case involving the alleged misuse of bank loans.
Agrawal was previously arrested in March during an investigation into alleged money laundering. He was released on a recognizance bond after giving a statement to investigators. The latest arrest, however, is linked to a separate banking offence case pending before the Patan High Court and is not a continuation of the earlier money laundering investigation.
According to investigators, Jagdamba Steels is accused of diverting loans obtained from several banks for industrial operations, working capital and raw material purchases to purposes other than those approved. Prosecutors allege that part of the borrowed funds was routed through multiple transactions and ultimately used for investments unrelated to the original loan agreements. The case has been filed against Shankarlal Agrawal, Sahil Agrawal, Sulabh Agrawal and businessman Deepak Bhatt.
The charge sheet names Shankarlal Agrawal as a defendant based on his alleged role in the company's banking and financial transactions. Investigators claim the accused acted in coordination in the movement of funds, although the extent of each individual's criminal liability will ultimately be determined by the court.
Prosecutors have sought recovery of the alleged misused amount, fines and imprisonment under Nepal's Banking Offence and Punishment Act. The Patan High Court will now decide whether Agrawal should remain in custody, be released on bail or under other conditions while the case proceeds. As the matter is still before the court, the allegations remain claims by the prosecution, and Agrawal is presumed innocent unless proven guilty.
