प्रतिनिधिसभा विघटनविरुद्ध सर्वोच्च अदालतमा दायर भएका १६ वटा रिट निवेदनमा आजदेखि सुनुवाइ सुरु भएको छ। सर्वोच्च अदालतका प्रवक्ता अर्जुनप्रसाद कोइरालाका अनुसार प्रधानमन्त्रीको नियुक्ति र संसद् विघटनको निर्णय बदर गरी संसद् पुनःस्थापना गर्न माग गर्दै दायर रिटहरूमाथि प्रारम्भिक सुनुवाइ प्रारम्भ भएको हो।
रिट निवेदनहरूमा उत्प्रेषण र परमादेश आदेश जारी गर्न माग गरिएको छ। यि रिटहरूमा प्रधानमन्त्री नियुक्तिको प्रक्रिया संवैधानिक व्यवस्थाविपरीत भएको र संसद् विघटन असंवैधानिक रहेको दाबी गरिएको छ।
सर्वोच्च अदालतले प्रारम्भिक सुनुवाइका क्रममा रिट निवेदनहरूलाई संयुक्तरूपमा सुनुवाइ गर्ने तयारी गरेको छ। अदालत स्रोतका अनुसार, आजको सुनुवाइपछि मुद्दा संवैधानिक इजलासमा पठाउने वा सामान्य इजलासमै निरन्तर सुनुवाइ गर्ने विषयमा निर्णय हुनेछ।
यसअघि पनि संसद् विघटनका मुद्दामा सर्वोच्चले ऐतिहासिक फैसला गर्दै संसद् पुनःस्थापना गरेको थियो, जसले देशको राजनीतिक दिशामा महत्वपूर्ण मोड ल्याएको थियो।
The Supreme Court of Nepal has begun hearings on 16 writ petitions filed against the dissolution of the House of Representatives. According to court spokesperson Arjun Prasad Koirala, the petitions seek to nullify the appointment of the Prime Minister and the dissolution of Parliament, demanding its reinstatement through writs of certiorari and mandamus.
The petitioners argue that both the Prime Minister’s appointment process and the decision to dissolve Parliament were unconstitutional and contrary to the provisions of the Constitution.
The Supreme Court has decided to conduct a joint preliminary hearing on all related petitions. According to court sources, today’s session will determine whether the cases will be referred to the Constitutional Bench or continue under the regular bench.
Earlier, the Supreme Court had issued a landmark verdict in a similar case, reinstating the dissolved Parliament, which had a profound impact on Nepal’s political landscape.
