सर्वोच्च अदालतले धरौटी बुझाउन नसकेर थुनामा रहेकाहरूलाई ६ महिनाभन्दा बढी कैदमा नराख्न आदेश गरेको छ। बैंकिङ कसुरको मुद्दामा कैद अवधि भुक्तान गरेर पनि जरिवाना बुझाउन नसकेका कारण थुनामा रहेका एक व्यक्तिको मुद्दाको व्याख्याका क्रममा यस्तो निर्णय गरिएको हो।
आदेशको मुख्य बुँदा:
६ महिनाभित्र फैसला गर्नुपर्ने:
मुलुकी फौजदारी कार्यविधि संहिता ऐन अनुसार, जरिवाना बापतको रकम धरौटी बुझाउन नसकेका व्यक्तिहरूले थुनामा बसेर मात्रै पुनरावेदन गर्न पाउँछन्। ऐनको दफा १३७ (६) मा त्यस्ता मुद्दाहरू ६ महिनाभित्र फैसला गर्नुपर्ने व्यवस्था छ।
अदालतले ६ महिनाभित्र फैसला नभएमा थुनामा रहेकाहरूलाई तारिखमा राखी मुद्दाको प्रक्रिया अघि बढाउन आदेश गरेको छ।
थुनामुक्त हुने सुविधा:
जरिवाना बुझाउन नसकेर थुनामा रहेका व्यक्तिहरूलाई ६ महिनाभित्र फैसला नभए थुनामुक्त गरिनुपर्नेछ।
यो सुविधा भने थुनामा राख्ने आदेश भएकाहरूलाई उपलब्ध हुने छैन।
विशेष आदेश:
पाँच जना न्यायाधीशको वृहत पूर्ण इजलासले बैंकिङ कसुरको आरोप लागेका महेन्द्र प्रसाद मिश्रको नाममा आदेश जारी गरेको छ, जसमा भनिएको छ, "कैदमा बसी पुनरावेदन दर्ता गरेको ६ महिना भित्र फैसला हुन नसकेको देखिँदा निजलाई कैदबाट मुक्त गरी तारिखमा राखी पुर्पक्ष गर्नु गराउनू।"
