For Nepali entrepreneurs planning to travel to Hong Kong for business purposes, understanding the rules and limitations under the Hong Kong Business/Visit Visa is essential. The Hong Kong Immigration Department allows foreign nationals, including Nepali citizens, to enter for short-term business visits, but these visits must remain within the scope of non-remunerative business activities. Violating these rules can lead to penalties, visa cancellation, or even imprisonment.

Under the business visit category, Nepali entrepreneurs can legally attend business meetings, trade negotiations, and product presentations. They can also participate in contract signing ceremonies, submit proposals, and finalize dealswith local Hong Kong companies. Such engagements are considered legitimate as long as no direct employment or paid work is involved. This allows foreign businesspersons to build partnerships and maintain international cooperation without needing a full employment visa.

However, certain restrictions apply. Visitors under this visa category cannot engage in any employment, whether paid or unpaid, and cannot manage or operate a local business during their stay. They are also prohibited from selling goods or services directly to the general public. For example, an exhibitor can display and promote their products during a trade fair, but they cannot accept cash payments or deliver products directly to customers in Hong Kong.

Additionally, business visitors are allowed to supervise the setup of exhibition booths, or inspect ongoing projects, but they may not physically construct or perform technical tasks. Their role must remain strictly supervisory or consultative. The Immigration Department emphasizes that visitor status does not confer the right to establish, join, or actively run a business.

For entrepreneurs who wish to set up or operate a company in Hong Kong, a separate visa type called “Investment as Entrepreneurs” must be obtained. This visa allows long-term residence and the right to manage local operations. Applicants for this type of visa must provide business plans, proof of capital, and evidence that their company will contribute to the Hong Kong economy through job creation or innovation.

Failure to comply with these conditions may result in a fine of up to HKD 50,000 and imprisonment for up to two years, according to Section 41 of the Immigration Ordinance (Cap. 115) of Hong Kong. Therefore, Nepali businesspeople should strictly adhere to permissible activities during their visit.
