उपभोक्ता संरक्षण विभागको कडा अनुगमन: १४ उद्योग–फर्ममाथि कारबाही, लाखौँ जरिवानाConsumer Protection Department Takes Action Against 14 Businesses; Fines Imposed for Unfair Trade Practices
पछिल्ला दिनमा बजार अनुगमन, निरीक्षण र कारबाही प्रक्रियालाई तीव्र बनाएको वाणिज्य, आपूर्ति तथा उपभोक्ता संरक्षण विभागले १४ वटा उद्योग तथा फर्ममाथि आइतबार कारबाही गरेको छ। उपभोक्तामाथि धोका हुने कार्य, गुणस्तरहीन सेवा र अनुचित व्यापारिक क्रियाकलापमा संलग्न भेटिएका व्यवसायलाई विभागले विभिन्न तहका जरिवाना र निर्देशन दिएको हो।
विभागका अनुसार भक्तपुर मध्यपुरथिमिमा अवस्थित हलेसी मार्ट प्रालिलाई २ लाख रुपैयाँ, र त्यही स्थानको ओम शिवशक्ति सेरामिक प्रालिलाई ५० हजार रुपैयाँ जरिवाना गरिएको छ। उपभोक्ता संरक्षण ऐन, २०७५ को दफा १६ र ३८ अनुसारका कसुरमा ऐनकै दफा ३९(१) बमोजिम विभागले तत्कालै कारबाही गरेको हो।
एकैपटक काठमाडौँ र भक्तपुरका विभिन्न उद्योग र प्रतिष्ठानमा गरिएको अनुगमनका क्रममा वस्तु तथा सेवाको वास्तविक गुणस्तर, परिमाण, मूल्य, नापतौल, ढाँचा तथा विक्री प्रक्रियामा कैफियत भेटिएका व्यवसायलाई कारबाही गरिएको विभागले जनाएको छ। यस्ता अनियमितता ‘अनुचित व्यापारिक तथा व्यवसायजन्य क्रियाकलाप’ को श्रेणीमा पर्ने हुन्छ।
उपभोक्ता संरक्षण ऐनको दफा ३९ अनुसार, अनुगमनका क्रममा तत्काल प्राप्त प्रमाणका आधारमा उत्पादन, ढुवानी, सञ्चयन, पैठारी र विक्री गर्ने व्यवसायले कसुर गरेको पाइएमा निरीक्षण अधिकृतले रु २ लाखदेखि ३ लाखसम्म जरिवाना गर्न सक्ने प्रावधान छ। विभागले यही अधिकार प्रयोग गर्दै पछिल्लो समयमा बजार नियमनलाई थप कडा बनाएको छ।
यसै क्रममा, काठमाडौँ क्षेत्रपाटीस्थित होम मेड स्पाइन्स एण्ड टी सप्लायलाई २० हजार रुपैयाँ, गट्ठाघरस्थित जिकेएसएस इन्टरप्राइजेज प्रालिलाई १० हजार रुपैयाँ, र क्षेत्रपाटीस्थित आशिष ट्रेड लिङ्कलाई १० हजार रुपैयाँ जरिवाना गरिएको छ। यी प्रतिष्ठानमा गुणस्तर, मूल्यसूचना तथा लेखापुस्तिकामा अनियमितता रहेको पाइएको विभागले बताएको छ।
यस्तै, काठमाडौँ क्षेत्रपाटीको आइके सर्जिकल सप्लायर्सलाई ५५ हजार रुपैयाँ जरिवानासहित २४ घण्टाभित्र उपस्थित हुन निर्देशन दिइएको छ। टोखा–८ मा अवस्थित सिटी मिनरल वाटर एण्ड बेभरेज प्रालिलाई भने व्यवसायसम्बन्धी कागजात सहित तीन दिनभित्र विभागमा उपस्थित हुन आदेश गरिएको छ।
अन्य ७ वटा उद्योग तथा फर्मलाई सामान्य निर्देशन दिइएको विभागले जनाएको छ। विभागले पछिल्ला दिनमा उपभोक्ताको हकहित संरक्षण, कालोपत्री रोकथाम, मूल्य नियन्त्रण तथा उपभोग्य वस्तुको गुणस्तर सुनिश्चितताका लागि अनुगमनलाई निरन्तर कडाइका साथ अघि बढाइरहेको छ।
The Department of Commerce, Supplies and Consumer Protection has intensified its market monitoring, inspection, and enforcement activities in recent days, taking action against 14 industries and business firms for violating consumer rights and engaging in unfair trade practices. The department conducted surprise inspections in various locations of Kathmandu and Bhaktapur and imposed fines on businesses found operating outside legal standards.
According to the department, Halesi Mart Pvt. Ltd. located in Madhyapur Thimi, Bhaktapur, has been fined Rs 200,000, whereas Om Shivashakti Ceramic Pvt. Ltd., also in the same area, has been fined Rs 50,000. These firms were penalized under Sections 16 and 38 of the Consumer Protection Act, 2075, and action was taken according to Section 39(1) of the same Act.
During the monitoring, authorities found discrepancies in several areas, including product quality, quantity, pricing, measurement, packaging, and sales practices. Such misconduct falls under "unfair commercial and business activities" as defined by the Consumer Protection Act. These violations directly affect consumer welfare, prompting the department to impose immediate penalties.
Section 39 of the Consumer Protection Act empowers inspection officers to impose fines ranging from Rs 200,000 to Rs 300,000 if evidence of wrongdoing is found during inspection, search, or inquiry. The department stated that this legal tool enables swift enforcement and has been crucial in identifying and penalizing businesses engaged in unethical trade behavior.
As part of the same enforcement drive, the department fined Home Made Spices & Tea Supply of Chhetrapati, Kathmandu Rs 20,000; GKSS Enterprises Pvt. Ltd. of Gattaghar Rs 10,000; and Ashish Trade Link of Chhetrapati Rs 10,000. These enterprises were found violating pricing rules, failing to maintain proper records, or providing misleading product information.
Additionally, IK Surgical Suppliers of Chhetrapati has been fined Rs 55,000 and ordered to appear before the department within 24 hours. Likewise, City Mineral Water & Beverages Pvt. Ltd., located in Tokha-8, Kathmandu, has been instructed to appear with its business documents within three days. These actions were taken after serious irregularities were detected during inspection.
The department reported that seven other businesses were issued general warnings and instructed to correct their practices immediately. Officials emphasized that ongoing monitoring efforts aim to safeguard consumers from exploitation, prevent adulteration, control price manipulation, and ensure quality standards in essential goods and services.
The Department of Commerce, Supplies and Consumer Protection has committed to continuing strict inspection and action campaigns to uphold consumer rights and maintain fair market practices across the country.
