विद्युत् नियमन आयोगले प्राधिकरणको निर्णयलाई सदर, उद्योगीको माग अस्वीकारElectricity Regulatory Commission Upholds NEA’s Decision, Rejects Industries’ Request
विद्युत् नियमन आयोगले ‘डेडिकेटेड’ र ‘ट्रंक लाइन’ महशुल विवादसम्बन्धी प्रकरणमा नेपाल विद्युत् प्राधिकरण (NEA) ले गरेको निर्णयलाई नै सदर गरेको छ। पञ्चकन्या प्लास्टिक इन्डस्ट्रिज प्रालि र पञ्चकन्या स्टिलले दर्ता गराएका उजुरीमाथि सुनुवाइ गर्दै आयोगले प्राधिकरणको बक्यौता उठाउने निर्णय कानुनी रूपमा सही रहेको ठहर गरेको हो।
दुवै उद्योगले प्राधिकरणबाट प्राप्त डेडिकेटेड र ट्रंक लाइनमार्फत लिएको विद्युत् महशुल लामो समयदेखि नतिर्दै आएका थिए। प्राधिकरणले बक्यौता तिर्न २१ दिनको समय दिएर कात्तिक ४ र ५ गते उद्योगको लाइन नै काटेको थियो। त्यसपछि उद्योगहरूले पहिलो किस्ताको महशुल बुझाउँदै आयोगमा अन्तरिम आदेश माग्दै उजुरी दिएका थिए।
आयोगका अध्यक्ष डा. रामप्रसाद धितालसहित पाँच सदस्यीय इजलाशमा भएको बहसमा प्राधिकरणका तर्फबाट राजकुमार पोखरेल, रमेशकुमार घिमिरे र तुलाराम गिरी उपस्थित थिए भने उद्योगी तर्फबाट रोजन खड्का बहसमा सहभागी थिए।
सुनुवाइपछि आयोगले प्राधिकरणले कानुनी प्रावधान अनुसार नै महशुल निर्धारण गरेको र तोकिएको समयमा महशुल नतिर्ने उपभोक्ताको लाइन काट्ने प्रावधान विधि अनुसार वैध भएको निष्कर्ष निकालेको छ। यसरी आयोगले अन्तरिम आदेश दिन अस्वीकार गर्दै प्राधिकरणकै निर्णयलाई समर्थन गरेको हो।
यद्यपि, आयोगले निर्णयप्रति चित्त नबुझेमा उजुरीदाताले अदालत जान सक्ने व्यवस्था खुला रहेको जनाएको छ।
The Electricity Regulatory Commission has upheld the decision made by the Nepal Electricity Authority (NEA) regarding the tariff dispute on dedicated and trunk line electricity services. Hearing the complaints filed by Panchakanya Plastics Industries Pvt. Ltd. and Panchakanya Steel, the Commission ruled that NEA’s decision to collect outstanding dues was legally valid and refused to issue an interim order.
Both industries had long been avoiding payment of electricity tariffs for power consumed through dedicated and trunk lines. After granting a 21-day deadline, NEA cut their power supply on Kartik 4 and 5 upon non-payment. Following the disconnection, the industries submitted an application to the Commission after paying the first installment and requested interim relief.
A five-member bench chaired by Dr. Ram Prasad Dhital conducted the hearing. NEA was represented by Raj Kumar Pokharel, Ramesh Kumar Ghimire, and Tularam Giri, while advocate Rojan Khadka argued on behalf of the industries.
After reviewing the case, the Commission concluded that NEA had determined the tariff in line with existing legal provisions. It also affirmed that cutting off the power line for failing to pay dues within the stipulated timeframe was permitted by law. Therefore, the Commission declined to issue an interim order and endorsed NEA’s actions.
However, the Commission clarified that the industries may approach the court if they are not satisfied with the decision.
