सरकारले जलस्रोत व्यवस्थापनलाई संघीय संरचनाअनुसार व्यवस्थित गर्न नयाँ छाता कानुन ल्याउने तयारीलाई तीव्र बनाएको छ । Ministry of Energy, Water Resources and Irrigation ले ‘जलस्रोत विधेयक २०८३’ को मस्यौदा परिमार्जन कार्य अन्तिम चरणमा पुर्याउँदै स्वीकृतिका लागि अघि बढाउने तयारी गरेको हो ।
हाल कार्यान्वयनमा रहेको जलस्रोत ऐन २०४९ लाई प्रतिस्थापन गर्ने उद्देश्यसहित ल्याउन लागिएको नयाँ विधेयकले संघ, प्रदेश र स्थानीय तहबीचको अधिकार बाँडफाँटलाई स्पष्ट कानुनी आधार दिने अपेक्षा गरिएको छ । नयाँ कानुन लागू भएपछि प्रदेश र स्थानीय तहहरूले पनि आफ्नो अधिकार क्षेत्रअनुसार छुट्टै कानुन बनाउन सक्ने व्यवस्था गरिनेछ ।
मन्त्रालयका अनुसार विधेयकको मुख्य उद्देश्य जलस्रोतको संरक्षण, समुचित उपयोग र दिगो विकास सुनिश्चित गर्नु हो । साथै जल उत्पन्न विपद् न्यूनीकरण, बहुआयामिक उपयोग र एकीकृत व्यवस्थापनलाई पनि प्राथमिकतामा राखिएको छ ।
विधेयकमार्फत जल तथा ऊर्जा आयोगको सचिवालयलाई थप अधिकार सम्पन्न बनाउने प्रस्ताव गरिएको छ । सचिवालयलाई जलस्रोतसम्बन्धी नीति समन्वय, नियमन तथा दीर्घकालीन योजना निर्माण गर्ने प्रमुख निकायका रूपमा विकास गर्ने तयारी गरिएको मन्त्रालयले जनाएको छ ।
सरकारले ऐनसँगै आवश्यक नियमावली निर्माणको काम पनि समानान्तर रूपमा अघि बढाएको छ, ताकि कानुन पारित भएसँगै कार्यान्वयन प्रक्रिया सहज रूपमा अघि बढाउन सकियोस् । मन्त्रालयले चालु संसद अधिवेशनबाटै विधेयक पारित गर्ने लक्ष्य राखेको छ । त्यसका लागि मस्यौदालाई जेठ पहिलो साताभित्र Ministry of Law, Justice and Parliamentary Affairs र मन्त्रिपरिषद्मा स्वीकृतिका लागि पेश गर्ने तयारी भइरहेको जनाएको छ ।
संघीय संरचनापछि जलस्रोत व्यवस्थापनमा स्पष्ट कानुनी आधार नहुँदा विभिन्न तहका सरकारबीच आयोजना स्वीकृति, स्रोत उपयोग र अधिकार क्षेत्रबारे अन्योल देखिँदै आएको थियो । नयाँ विधेयकले त्यस्ता अस्पष्टता हटाउँदै जलस्रोत विकासलाई थप संस्थागत, व्यवस्थित र दीगो बनाउने अपेक्षा गरिएको छ ।
The government is accelerating preparations to introduce a new umbrella law aimed at restructuring water resource management in line with Nepal’s federal system. The Ministry of Energy, Water Resources and Irrigation has completed the revision process of the proposed “Water Resources Bill 2083” and is preparing to move it forward for approval.
The proposed legislation is intended to replace the existing Water Resources Act 2049 and establish a clearer legal framework for the division of authority among the federal, provincial and local governments as envisioned by the Constitution. Once enacted, provincial and local governments will also be able to formulate their own laws within their respective jurisdictions.
According to the ministry, the primary objective of the new bill is to ensure the protection, sustainable use and balanced development of water resources. The proposed law also prioritizes integrated water management, disaster risk reduction and the long-term conservation of water-based resources.
The bill proposes expanding the authority of the Water and Energy Commission Secretariat by strengthening its role in policy coordination, regulation and long-term planning related to water resources. Officials say the government plans to develop the secretariat into a central coordinating institution for integrated water governance.
The ministry is simultaneously working on drafting the necessary regulations alongside the bill so that implementation can begin immediately after the law is passed.
The government aims to endorse the bill during the current parliamentary session. Preparations are underway to submit the draft to the Ministry of Law, Justice and Parliamentary Affairs and the Cabinet for approval within the first week of Jestha.
Following the transition to a federal structure, lack of a clear legal framework for water resource management had created confusion among different levels of government regarding project approvals, jurisdiction and resource utilization. Officials believe the new legislation will help remove such ambiguities and make water resource development more institutionalized, coordinated and sustainable.
