नेपाल सरकारको श्रम तथा व्यवसायजन्य सुरक्षा विभागले निजी अस्पताल, बैंक तथा वित्तीय संस्था लगायतका प्रतिष्ठानमा श्रम कानुन पालना नभएको पाइएको जनाएको छ। विभागले शुक्रबार प्रेस विज्ञप्ति जारी गर्दै अनुगमनका क्रममा श्रम ऐन र नियमावलीविपरीतका गतिविधि देखिएको भन्दै सम्बन्धित संस्थाहरूको ध्यानाकर्षण गराएको हो।

विभागका अनुसार पछिल्ला अनुगमनमा केही निजी अस्पतालमा कार्यरत चिकित्सक, स्वास्थ्यकर्मी तथा आपूर्ति गरिएका श्रमिकलाई ओभरटाइमबापतको पारिश्रमिक उपलब्ध नगराइएको भेटिएको छ। लामो समयसम्म लगातार काममा लगाउने तर सरकारले तोकेको न्यूनतम पारिश्रमिकसमेत नदिएको पाइएपछि विभागले ती संस्थाहरूलाई सुधार गर्न निर्देशन दिएको छ।

बैंक तथा वित्तीय संस्थामा आपूर्ति गरिएका सुरक्षाकर्मी र अन्य श्रमिकको हकमा पनि उस्तै समस्या देखिएको विभागले जनाएको छ। न्यूनतम पारिश्रमिक नदिने, निर्धारित समयभन्दा बढी काम लगाउने र चाडपर्व खर्च उपलब्ध नगराउने गुनासो आएपछि विभागले कानुनी व्यवस्था कार्यान्वयन गर्न ती संस्थाहरूलाई पत्राचार गरेको छ।

विभागले श्रमिक आपूर्ति गर्ने कम्पनी र श्रमिक प्रयोग गर्ने प्रतिष्ठान दुवैले प्रचलित कानुन पालना गर्नुपर्ने जनाएको छ। श्रम ऐन २०७४ अनुसार इजाजत प्राप्त कम्पनीले सुरक्षा, सरसफाइ, व्यावसायिक सहयोग र घरेलु सहयोगजस्ता तोकिएका सेवामा मात्रै श्रमिक आपूर्ति गर्न पाउने व्यवस्था छ।

विज्ञप्तिमा उल्लेख भएअनुसार विभागले २०८२ साउनदेखि २०८३ जेठ मसान्तसम्म ३ हजार २ सय ६७ प्रतिष्ठानमा श्रम निरीक्षण गरेको छ। सोही अवधिमा ३ हजार १ सय ३७ प्रतिष्ठानमा बाल श्रम निरीक्षण गरिएको र ३ हजार ३ सय ९० श्रम अडिट प्रतिवेदन प्राप्त भएको विभागले जनाएको छ।

त्यसैगरी, २०८२ चैत १३ देखि २०८३ असार १० गतेसम्मको छोटो अवधिमा मात्रै ७ सय ६१ प्रतिष्ठानमा श्रम निरीक्षण गरिएको छ। सो अवधिमा ६ सय ७९ वटा श्रम अडिट प्रतिवेदन प्राप्त भएको विभागको तथ्यांक छ।

श्रम नियमावली २०७५ को नियम ५६ अनुसार प्रत्येक प्रतिष्ठानले हरेक वर्ष पुस मसान्तभित्र श्रम अडिट गराउनुपर्ने कानुनी व्यवस्था छ। तर, कतिपय प्रतिष्ठानले उक्त व्यवस्था पालना नगरेको विभागको भनाइ छ।

विभागले सबै प्रतिष्ठानलाई श्रम ऐन २०७४ र श्रम नियमावली २०७५ का प्रावधान पूर्ण रूपमा कार्यान्वयन गर्न आग्रह गरेको छ। कानुन पालना नगर्ने प्रतिष्ठानमाथि आवश्यक कानुनी कारबाही अघि बढाइने विभागका प्रवक्ता ई. मणिनाथ गोपद्वारा जारी विज्ञप्तिमा उल्लेख छ।

The Department of Labour and Occupational Safety has raised concern over serious violations of labour laws in several private hospitals, banks and financial institutions.

Issuing a press statement on Friday, the department said recent inspections found that some institutions had failed to comply with the Labour Act and related regulations. It warned that establishments ignoring existing legal provisions could face action.

According to the department, doctors, health workers and outsourced employees working in some private hospitals were not paid overtime wages. In several cases, workers were reportedly made to work for long hours continuously without receiving the minimum wage fixed by the government.

The department said institutions where such irregularities were found have already been instructed to make necessary corrections within the given deadline.

Similar problems were also reported in banks and financial institutions, particularly among outsourced security personnel and other workers. The department said complaints had been received that such workers were not being paid minimum wages, were made to work excessive hours and were not provided festival allowances.

Following the complaints, the department has written to the concerned institutions, asking them to implement the legal provisions related to wages, working hours and worker benefits.

The department said it conducted labour inspections in 3,267 establishments between Shrawan 2082 and the end of Jestha 2083. During the same period, child labour inspections were carried out in 3,137 establishments, while 3,390 labour audit reports were received.

Similarly, between Chaitra 13, 2082 and Asar 10, 2083, the department inspected 761 establishments and received 679 labour audit reports.

As per Rule 56 of the Labour Rules 2075, every establishment is required to conduct a labour audit by the end of Poush every year. Likewise, Section 59 of the Labour Act 2074 allows licensed companies to supply workers only for specified services such as security, cleaning, business support and domestic support.

The department has urged all establishments to fully implement the provisions of the Labour Act 2074 and Labour Rules 2075. It said necessary legal action would be taken against institutions that fail to comply with labour laws.

The statement was issued by the department’s spokesperson, Engineer Maninath Gop.
