“बैंकर” र “व्यवसायी” छुट्याउन खोजेको दुई वटा दफाहरु यहाँ चर्चा गरेको छुः पहिलो हो दफा ५२ (१) - यस दफामा भनिएको छः “बैक तथा वित्तीय संस्थाले आफुसंग सम्बध्द व्यक्ति वा कुनै बैकमा उल्लेख्य स्वामित्व भएको व्यक्तिलाई कुनै किसिमको कर्जा वा सुविधा प्रदान गर्न पाउने छैन।” यस दफामा प्रयोग भएका तीन वटा शव्दहरुमा यहाँको ध्यान आकर्षण गर्दछु- “आफुसंग”, व्यक्ति र “बैंक” दफा २ मा भएको परिभाषा हेर्दा “बैक” भनेको बाणिज्य बैंक र पूर्वाधार विकास बैंक हो! परिभाषा अनुसार “सम्बध्द व्यक्ति” मा प्रयोग भएको “व्यक्ति” को अर्थ अनुसार प्राकृतिक र कृत्रिम व्यक्ति अर्थात् व्यक्ति तथा संस्था / कम्पनी दुवै पर्दछन भने “उल्लेख्य स्वामित्व” भएको वाक्यांशमा प्रयोग भएको “व्यक्ति” प्राकृतिक व्यक्ति मात्र हो र यस्ले संस्था / कम्पनीलाई समेट्दैन।Why is there fear regarding the proposed amendments in the Banking and Financial Institution Act (BAFIA)? Two sections that seek to distinguish between "bankers" and "businesspeople" have been discussed here: The first is Section 52(1), which states: "A bank or financial institution shall not provide any loan or facility to a person who has a significant ownership in the bank or financial institution or to a related party." The key terms in this section are "related," "person," and "bank." According to the definition in Section 2, "bank" refers to commercial banks and infrastructure development banks. The definition of "related person" includes both natural persons (individuals) and legal persons (companies and institutions). However, the term "significant ownership" refers only to natural persons, not institutions. Therefore, according to the proposed amendment, a bank or financial institution cannot provide loans or facilities to a related person or institution. However, such related persons or institutions may still borrow from other banks and financial institutions. The current law does not contain the term "related," and the proposed amendment clarifies this by making the provision more liberal. This change does not appear to have any significant impact.

घरजग्गा कारोबारमा अनिवार्य बैंक स्टेटमेन्ट र विद्युतीय कारोबार प्रणाली लागू सरकारले सम्पत्ति शुद्धीकरण (मनी लाउन्डरिङ्ग) र आतंकवादी क्रियाकलापमा वित्तीय लगानी नियन्त्रण गर्नका लागि अबदेखि घरजग्गा खरिद–बिक्री गर्दा कडा प्रावधान लागू गर्ने भएको छ। अबदेखि घरजग्गा कारोबार गर्दा खरिदकर्ता र बिक्रीकर्ताको बैंक स्टेटमेन्ट र केवाइसी फारम अनिवार्य रुपमा पेश गर्नुपर्नेछ। भूमि व्यवस्था, सहकारी तथा गरिबी निवारण मन्त्रालयले मनी लाउन्डरिङ्ग निवारण ऐन २०६४ को दफा ७ (न) को उपदफा (२) अनुसार सम्पत्ति शुद्धीकरण तथा आतंकी क्रियाकलाप नियन्त्रणसम्बन्धी निर्देशन २०८२ जारी गर्दै यो व्यवस्था लागू गरेको हो। मालपोत तथा भूमिसुधार कार्यालयहरूलाई पनि कार्यान्वयनका लागि निर्देशन दिइसकिएको छ।Government Tightens Real Estate Transactions: Bank Statements & KYC Now Mandatory In a major step to curb money laundering and increase financial transparency, the Government of Nepal has enforced stricter regulations for buying and selling land and property. From now on, both the buyer and seller must submit their bank statements and KYC forms before the property transaction is approved. The Ministry of Land Management, Cooperatives, and Poverty Alleviation implemented this rule under Section 7(n), Sub-section (2) of the Money Laundering Prevention Act, 2008 (2064 BS). Instructions have already been sent to land revenue and land reform offices nationwide to enforce the rule.

Despite Rs. 212 billion yet to mature, the central bank is using its deposit collection instrument to mop up surplus funds. The deposit collection will be for a 21-day period, with bidding scheduled for 3 PM today. Bids must be placed in a minimum amount of Rs. 100 million, with increments in multiples of Rs. 50 million. Any leftover amount after division will not be accepted. The maturity date, including principal and interest, is set for Ashad 8 (approximately three weeks from today).
